These Terms of Service govern access to and use of the Axivelly online store, website features, content, and related services. Axivelly is operated by Hainan Xinyuanxin Internet Technology Co., Ltd. By using the store, you agree to these Terms. If you do not agree, do not use the store.
1. Store Platform
Our store is hosted through Shopify, which supplies the ecommerce platform. Purchases from Axivelly are transactions between the customer and Hainan Xinyuanxin Internet Technology Co., Ltd., subject to these Terms and applicable law.
2. Eligibility
You may use the store only if you have legal capacity to enter into the relevant transaction or valid authorization from a parent, guardian, business, or account holder. You are responsible for accurate information and activity conducted through your account or checkout details.
3. Permitted Use
You must not use the store unlawfully; submit false, fraudulent, or unauthorized information; interfere with security or operation; introduce harmful code; scrape content without permission; attempt unauthorized access; impersonate another person; facilitate fraud; or circumvent purchase limits or controls.
We may restrict access where reasonably necessary to protect the store, customers, providers, or legal rights.
4. Product Information
We seek to describe products reasonably accurately. Colors and appearance may vary because of screens, lighting, materials, and manufacturing. Measurements may contain reasonable tolerances. Minor packaging or product details may change if function and value are not materially reduced.
5. Availability and Order Limits
Products may be limited. We may impose reasonable limits per customer, household, account, payment method, or order. Cart placement does not reserve stock. We may refuse or cancel an order for legitimate reasons, including unavailability, payment failure, suspected fraud, delivery restrictions, or obvious errors.
6. Prices and Payment
Prices and currencies are displayed on the store or at checkout. Shipping, taxes, duties, and other charges are shown or described where applicable. You must provide current billing information and use an authorized payment method.
We may correct an obvious error before accepting or dispatching an order. If a correction materially affects the order, we will provide notice and any cancellation or refund right required by law.
7. Purchases
Purchases are also governed by our Terms of Purchase, Shipping Policy, Cancellation Policy, and Return & Refund Policy.
8. Intellectual Property
The store and its text, layout, graphics, logos, photographs, videos, and other content are owned by or licensed to Axivelly and protected by law. You may view content for personal shopping purposes but may not reproduce, modify, distribute, sell, or commercially exploit it without permission, except where law permits.
9. Reviews and Submitted Content
If you submit a review, photograph, feedback, or other content, you confirm that you have the right to provide it and that it is not unlawful, deceptive, defamatory, infringing, or harmful.
To the extent permitted by law, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use the content for operating, improving, and promoting the store. Ownership remains with you. We may moderate or remove content that violates these Terms.
10. Third-Party Services
The store may use payment providers, carriers, social platforms, and external websites governed by separate terms and policies. We are not responsible for independent third-party practices except where liability cannot legally be excluded.
11. Privacy
Our processing of personal information is described in the Privacy Policy and remains subject to applicable law and available privacy choices.
12. Service Availability
We may maintain, modify, suspend, or discontinue store features. We do not guarantee uninterrupted or error-free availability in every location. Temporary technical errors create no liability beyond remedies required by law.
13. Disclaimers
To the fullest extent permitted by law, the store and general content are provided on an “as available” basis. We make no warranty not expressly stated or legally required. This does not exclude statutory warranties or mandatory consumer rights.
14. Limitation of Liability
To the fullest extent permitted by law, Axivelly and Hainan Xinyuanxin Internet Technology Co., Ltd. are not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable. Nothing excludes liability that cannot legally be waived.
15. Indemnification
To the extent permitted by law, you are responsible for losses and reasonable costs resulting from your unlawful use, infringement of another person’s rights, or material breach. This does not make you responsible for losses caused by our own breach, negligence, or unlawful conduct.
16. Suspension and Termination
We may suspend or terminate access for a material violation, security threat, fraud, abuse, or legal risk. Provisions that should naturally continue, including intellectual-property, liability, payment, and dispute provisions, survive termination.
17. Governing Law
These Terms are governed by laws applicable at the registered location of Hainan Xinyuanxin Internet Technology Co., Ltd., without excluding mandatory consumer protections in the customer’s place of residence.
Disputes should first be sent to service@axivelly.com for a good-faith attempt at resolution. Nothing prevents use of a court, regulator, or dispute process available under mandatory law.
18. Severability and No Waiver
If a provision is unenforceable, it will be limited or removed only as necessary, and the remainder will continue. Failure to enforce a provision once is not a permanent waiver.
19. Changes
We may revise these Terms when reasonably necessary. Changes will not retroactively reduce rights arising from an accepted order unless law permits and customer agreement is obtained where required.
